1. WHO WE ARE

This Privacy Policy explains how Phaztech LLC (“Phaztech,” “we,” “us,” or “our”) collects,
uses, and shares information in connection with your purchase and use of our TradeStation
indicator products and related services (the “Products”).

2. INFORMATION WE COLLECT

2.1 Information You Provide. When you purchase a Product through Whop, Whop collects your
name, email address, billing address, and payment information on our behalf. We receive
your email address and purchase details from Whop in order to issue your license and
provide support — we do not receive or store your full payment card details ourselves.
2.2 License and Device Information. When you activate a license key, our license
verification server (self-hosted, operated by us) records: the license key used, a device
fingerprint derived from your computer (used to enforce the number of devices permitted per
license — we do not collect your device’s personally identifying hardware details beyond
what’s needed for this fingerprint), the date/time of activation and periodic
re-validation, and whether validation succeeded.
2.3 Communications. If you email us for support, we retain that correspondence to respond
to and track your request.
2.4 Automatically Collected Information. Our license server and email-delivery systems may
log technical information such as IP address, timestamps, and error logs, for security and
troubleshooting purposes.

3. HOW WE USE YOUR INFORMATION

We use the information above to:
– Process your purchase and issue your license key
– Deliver your license key and product files to you by email
– Validate your license and enforce the device limit associated with it
– Provide customer and technical support
– Communicate with you about your purchase, license, or (if you opt in) product updates
– Detect and prevent fraud, abuse, or violations of our Terms of Service
– Comply with legal obligations

4. THIRD-PARTY SERVICE PROVIDERS

We share information with the following categories of service providers, each of which
processes data under its own privacy policy:
– Whop — payment processing, order/checkout data, and (for tax-enabled sales) sales tax
collection and remittance.
– Resend — our email delivery provider, used to send your license key and related
transactional emails.
– Hostinger — our web hosting and business email provider.
– Our self-hosted license server — operated by us on infrastructure we control, used
solely to validate license keys and enforce device limits. We do not use this data for
marketing or share it with anyone outside Phaztech.
We do not sell your personal information to third parties.

5. DATA RETENTION

We retain purchase, license, and device-activation records for as long as your license
remains active and for a reasonable period afterward, as needed to provide support, comply
with legal/tax obligations, and resolve disputes. You may request deletion of your
information as described in Section 7, subject to our legitimate need to retain certain
records (e.g., for tax or legal compliance).

6. INTERNATIONAL USERS

We sell to customers in any country supported by Whop. If you are located outside the
United States, please be aware that your information may be transferred to, stored, and
processed in the United States or other countries where our service providers operate,
which may have different data protection laws than your country of residence.
6.1 European Economic Area, UK, and Switzerland. If you are located in the EEA, UK, or
Switzerland, you may have rights under applicable data protection law (such as the GDPR)
including the right to access, correct, delete, restrict, or object to our processing of
your personal data, and the right to data portability. To exercise these rights, contact us
at support@phaztech.com.
6.1.1 Our Lawful Basis for Processing. We process your personal data on the following legal
bases under Article 6 GDPR:
– Contract performance (Art. 6(1)(b)) — collecting your purchase details, issuing your
license key, and validating your license and device limit, all of which are necessary
to provide the Product you purchased.
– Legitimate interests (Art. 6(1)(f)) — automatically collected technical/log data (IP
address, timestamps, error logs) and license-activation records, which we use for
fraud/abuse prevention, security, and troubleshooting; we consider these interests to be
proportionate and not overridden by your privacy interests, given the limited data
involved and its narrow use.
– Consent (Art. 6(1)(a)) — any optional product-update or marketing communications you
opt into; you may withdraw this consent at any time by contacting us or using any
unsubscribe mechanism provided in those communications.
– Legal obligation (Art. 6(1)(c)) — retaining records as needed to comply with tax,
accounting, or other legal requirements.
6.1.2 International Transfers. Because we and our service providers (Whop, Resend, and
Hostinger) operate primarily in the United States, your personal data will be transferred
to and processed in the United States. Each of these providers has represented that it
maintains the EU Commission’s Standard Contractual Clauses (SCCs) as a safeguard for
transfers of personal data out of the EEA/UK/Switzerland; Resend additionally participates
in the EU-U.S. Data Privacy Framework (including its UK Extension). We rely on these
mechanisms, as adopted by our service providers, as the basis for these transfers.

GDPR/SCC representations as of this document’s drafting (Resend: resend.com/security/gdpr and
resend.com/legal/dpa; Whop: whop.com/privacy; Hostinger: hostinger.com/legal/dpa) — please
confirm current accuracy before publishing, and advise whether Phaztech should also execute
its own Article 28 Data Processing Agreement with each provider (Resend’s is pre-signed and
downloadable from their dashboard; confirm the same is available/needed for Whop and
Hostinger) and whether a Record of Processing Activities (Art. 30) or DPO designation is
warranted given Phaztech’s scale.]
6.2 California Residents. If you are a California resident, you may have rights under the
California Consumer Privacy Act (CCPA), including the right to know what personal
information we collect and the right to request deletion. To exercise these rights, contact

limiting access to license and customer data to what is necessary to operate our business.
No method of transmission or storage is completely secure, and we cannot guarantee absolute
security.

9. CHILDREN’S PRIVACY

The Products are not directed to, and we do not knowingly collect personal information
from, anyone under the age of 18. If you believe a child has provided us with personal
information, please contact us so we can delete it.
